1. General Provisions
1.1. This document is an official public offer (the "Offer") of KHOOD FINTECH – FZCO, Registration No. 82158, Trade licence No. 88918, Dubai Integrated Economic Zones Authority, IFZA Business Park, DDP, PO Box 342001, Dubai, United Arab Emirates (the "Company", "KHOOD", "we"), addressed to any individual (the "User", "Trader", "you") who meets the eligibility requirements of the Platform Terms of Use.
1.2. The Offer, together with the Platform Terms of Use, the Privacy Policy, the Refund Policy and the Anti-fraud Policy published on khood.capital (the "Platform"), constitutes the entire agreement between the Company and the User (the "Agreement"). The listed documents are integral parts of the Agreement.
1.3. Acceptance of this Offer constitutes full and unconditional acceptance of all documents listed in clause 1.2.
2. Subject of the Agreement
2.1. The Company provides the User with access to a paid evaluation program (a "Challenge") — a digital service for evaluating trading skills on an account with predefined parameters in a simulated environment with market quotes.
2.2. Upon successful completion of all stages of the Challenge, the Trader is granted access to a funded account on a profit-sharing basis in accordance with the Challenge Rules and the Terms of Use. Rewards are paid from the Company's own funds.
2.3. KHOOD is a technology platform for evaluating traders' skills. The Company is not a broker, does not provide brokerage or investment services, does not accept deposits and does not manage client funds.
3. Acceptance of the Offer
3.1. The Offer is accepted by paying the Challenge fee using any payment method available on the Platform. The Agreement is deemed concluded at the moment the payment is confirmed.
3.2. By accepting the Offer, the User confirms that they: (a) are at least 18 years old; (b) are not a resident of Russia, Belarus, Iran, North Korea, Myanmar, other sanctioned countries or countries on the FATF blacklist; (c) have provided accurate information; (d) have read and accepted the documents listed in clause 1.2.
4. Price and Payment
4.1. Challenge fees and fees for additional options are stated in US dollars (USD) on the plan pages of the Platform as of the date of payment.
4.2. The version of the Agreement and the fee in effect on the payment date apply to that payment.
5. Provision of the Service
5.1. Access to the evaluation account (credentials) is provided after payment confirmation.
5.2. The service is deemed rendered upon activation of the evaluation account, as defined in Section 2 of the Refund Policy. Refunds and payment cancellations are governed by the Refund Policy.
6. Liability
6.1. Trading involves a high level of risk; the Company does not guarantee profit and is not liable for the User's trading decisions.
6.2. The Company's aggregate liability under the Agreement is limited to the amount actually paid by the User for the relevant Challenge.
7. Amendments and Term
7.1. The Company may amend this Offer and the documents listed in clause 1.2 by publishing updated versions on the Platform. Amendments have no retroactive effect: the version in effect on the payment date applies to that payment.
7.2. The Offer remains in force until withdrawn or replaced by the Company.
8. Governing Law and Disputes
8.1. The Agreement is governed by the laws of the United Arab Emirates and the rules of the IFZA Free Zone. Disputes are resolved by the competent authorities of the UAE.
